1. Definitions

In this document:

  • “Company”: Quadralto SRL.
  • “Service”: “Accessibility Checker” software, analysis and reporting features, as well as IT consulting activities and prepaid work hours available for purchase through e-commerce.
  • “Client”: the individual or legal entity using or purchasing the Service.
  • “Account”: the account created by the Client to access the Service.
  • “Client Data”: any information or content provided by the Client through the Service.

2. Acceptance of Terms

Use of the Service implies full acceptance of these Terms. If the Client represents a company, they declare they have the necessary authority to bind the company itself.

3. Purpose of the Service

The Service consists of:

  • access to the SaaS platform “Accessibility Checker PRO”, which performs automatic website analyses according to WCAG guidelines;
  • generation of reports and use of features offered by the dashboard;
  • consulting activities and technical support in IT and digital accessibility, which may be purchased in prepaid hour packages.

The Service is provided “as is” and may be updated or modified by the Company at any time.

4. License and Permitted Use

The Client obtains a non-exclusive, non-transferable, and revocable license to use the Service, limited to their internal purposes.
It is prohibited to:

  • copy, distribute, modify, or decompile the software;
  • use the Service for illegal activities;
  • allow unauthorized third parties to access it.

5. Prices and Payments

Prices are indicated on the site or in the purchase order.

  • Payment is in advance and may cover subscriptions, scan packages, or prepaid consulting hours.
  • Payments are managed through the methods indicated on the site.
  • Any unpaid amounts may result in the suspension of the Account.

6. Duration, Renewal, and Termination

  • Subscription services remain active until the end of the paid period.
  • The Client may cancel the subscription at any time from their account area or by contacting support at orders@visibitaly.com.
  • Cancellation prevents automatic renewal but does not affect access until the end of the already-paid period.
  • Automatic renewal occurs only if not canceled at least 2 days before expiration.
  • Upon termination, the Client loses access to the Service and data may be retained for a limited time as stated in the Privacy Policy.

7. Support and SLA

The Company provides technical support via ticket during the following hours: Mon.-Fri. 9:30 AM-6:30 PM.
Any SLAs (response times or guaranteed uptime) are specified separately in the purchased plans.

8. Intellectual Property

  • All rights to the software, trademarks, logos, designs, and content belong to the Company.
  • Data entered by the Client remains their property.
  • Feedback, suggestions, or improvement requests may be freely used by the Company without obligation of compensation.

9. Limitation of Liability

The Service is provided “as is.”

  • We do not guarantee that reports are error-free or fully meet specific legal requirements.
  • In no event shall the Company be liable for indirect damages, loss of profits, business interruption, or data loss.
  • The maximum liability shall be limited to the amount actually paid by the Client in the 12 months preceding the damaging event.

10. Acceptable Use

The Client agrees not to use the Service for:

  • purposes contrary to the law;
  • activities that violate third-party rights;
  • compromising the security or integrity of the platform.

The Company reserves the right to suspend or close accounts in case of violations.

11. Privacy and Data Protection

The processing of personal data is governed by the Privacy Policy available on the site.
The Company adopts appropriate technical and organizational measures for data protection and may use external providers (hosting, cloud, analytical tools) compliant with GDPR.

12. Changes to Terms

The Company may modify these Terms by notifying via email or on the site. Changes will take effect 30 days after publication. Continued use of the Service implies acceptance of the changes.

13. Governing Law and Jurisdiction

These Terms are governed by Italian law.
For any dispute, the exclusive jurisdiction shall be the court of Milan, unless otherwise provided by mandatory law.

14. Force Majeure

The Company shall not be liable for non-fulfillment due to force majeure (blackouts, cyberattacks, natural events, strikes, etc.).

15. Final Clauses

These terms constitute the entire agreement between the Client and the Company. If any provision is declared invalid, the remaining provisions shall remain fully valid and effective.
